By accessing and using this website, booking a package, or purchasing any product or service from Pumpkin Up Decor LLC, you agree to the following terms and conditions:
1. Intellectual Property
All content on this site—including images, logos, product names, and branding—is the property of Pumpkin Up Decor LLC. It may not be reproduced, distributed, or used without written permission.
2. Booking & Availability
Delivery and installation slots are scheduled on a first-come, first-served basis and are only available within our defined service area. We reserve the right to refuse service if a location is deemed inaccessible, unsafe, or outside of our delivery zone. We will contact you in such cases to resolve or cancel the order.
All prices are subject to change without prior notice. A confirmed booking locks in your selected pricing.
3. Payments Terms
Full payment is required at the time of booking to secure your package and delivery slot. While you’ll select a preferred delivery week during checkout, final delivery dates may vary slightly based on availability and routing.
Prices listed reflect the base cost; delivery, installation, and disposal fees are calculated during package customization and added before payment. We accept major credit and debit cards through secure online checkout.
All payments are non-refundable once your booking is confirmed, except in cases of cancellation by Pumpkin Up Decor LLC.
4. Cancellations & Refunds
Please refer to our dedicated Return & Refund Policy for full details on cancellations, rescheduling, and refunds. This policy outlines the terms for changing or canceling your booking and any applicable fees based on timing or service type.
5. Client Responsibilities
Clients are responsible for providing an accurate delivery address, clear access instructions, and ensuring their designated installation area (typically the front porch or main front-facing entry) is clear of debris, furniture, active pets, and other obstructions for safe and efficient setup.
For any alternate installation requests (backyards only) or to report potential access issues (e.g., locked gates, ongoing construction), clients must notify us at least 7 days before their scheduled delivery. Backyard installations may incur an additional $75 service fee, dependent on complexity and access.
Failure to meet these responsibilities may result in delays, partial or incomplete installation, or additional service fees.”
6. Service Scope & Limitations
Our standard installation includes the precise layout and styling of pumpkins and decorative items as part of your selected package (or if installation was added as an upgrade). However, our service does not include sweeping, power-washing, or cleaning of your porch or steps; nor does it cover the removal or rearrangement of any existing furniture or decor. We also do not provide installation of custom lighting, drilling, anchoring, or any structural modifications to your property. Clients are solely responsible for ensuring their installation area is clean and fully ready for setup upon our arrival. If the space is not adequately prepared, the setup may be delayed or adapted based on the conditions present at the time of service.
7. Natural Product Disclaimer & Replacements
Our pumpkins and decorative elements are real, seasonal products sourced from regional farms. Due to their organic nature, we cannot guarantee exact longevity or resistance to heat, moisture, sun exposure, or animal activity.
We are not responsible for damage caused by squirrels, raccoons, deer, pets, or other wildlife. If damage is reported within 7 days of delivery and is deemed excessive and unrelated to natural aging or environmental conditions, we may offer a one-time partial replacement—subject to product availability and additional delivery fees.
8. Handling & Safety
Pumpkin Up Decor LLC is not liable for any injuries, property damage, or loss resulting from the handling, moving, or modification of any items after delivery.
Clients who choose to self-install package or choose to rearrange their display after installation do so at their own discretion and assume full responsibility for any lifting, placement, or safety considerations.
9. Delivery Areas
Pumpkin Up Decor LLC delivers within defined service zones in the DFW metroplex. Delivery is only available to addresses within our approved core and extended zones. Orders placed outside of these zones may be canceled or subject to additional fees, with notice.
10. Force Majeure
Pumpkin Up Decor LLC shall not be held liable for any failure or delay in performance caused by events beyond our reasonable control. This includes, but is not limited to, acts of God (such as hurricanes, extreme freezes, or wildfires), natural disasters, severe weather conditions, farm shortages, labor disputes, government actions, or other unforeseen emergencies.
In the event of such disruptions, we will communicate with affected clients as soon as possible to discuss available options. These may include rescheduling, issuing a credit, or providing a full refund minus any processing fees, at our discretion.
11. Illustrative Imagery & Product Variances
Images displayed on our website, social media, and marketing materials are for illustrative and inspirational purposes only. While we strive to create beautiful and high-quality displays, actual results may vary based on factors such as the specific package selected, the availability and natural characteristics of seasonal products (e.g., pumpkin size, shape, color, natural imperfections), and the unique dimensions and features of your property. We do not guarantee an exact replication of any illustrative images.
12. Porch Photography
For quality control and portfolio purposes, Pumpkin Up Decor LLC may take photographs of your installed decor on your property after setup. All ownership rights to these photographs remain with Pumpkin Up Decor LLC. These images will only be shared publicly (e.g., on our website, social media, or marketing materials) with your explicit consent, which you will have the opportunity to provide or deny during the booking or checkout process.”

14. Dispute Resolution
In the event of any dispute arising from or related to these Terms & Conditions or our services, both parties agree to first attempt to resolve the matter amicably through good-faith discussions. If a resolution cannot be reached, any legal action shall be filed and conducted exclusively in the state or federal courts located in Tarrant County, Texas. Each party will bear its own legal costs and attorney’s fees unless otherwise determined by the court.
15. Governing Law
These Terms & Conditions and any disputes arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action must be filed and heard exclusively within the jurisdiction of state and federal Texas courts, specifically in Tarrant County jurisdiction.
